Dealing with an auto accident claim in Ontario involves several steps to ensure that you follow the legal requirements and receive proper compensation. Here’s a comprehensive guide to help you through the process:

1. Immediate Actions at the Scene

  • Safety First: Ensure everyone’s safety. Move to a safe location if possible and call emergency services if there are injuries.
  • Call the Police: Report the accident if there are injuries, significant damage (usually over $2,000), or if any involved driver does not have insurance.
  • Exchange Information: Collect names, addresses, phone numbers, driver’s license numbers, license plate numbers, and insurance details from all parties involved.
  • Document the Scene: Take photos of the damage, the accident scene, and any relevant road conditions or traffic signs.

2. Reporting the Accident

  • Report to the Police (if not done at the scene): If police are not called to the scene, you must report the accident to a Collision Reporting Centre within 24 hours if the damage exceeds $2,000.
  • Notify Your Insurance Company: Inform your insurance company as soon as possible, typically within 7 days of the accident, or as required by your policy.

3. Filing the Insurance Claim

  • Gather Documentation: Collect all relevant information such as the accident report, photos, and any correspondence with other parties involved.
  • Submit the Claim: Contact your insurance company to start the claim process. Provide all necessary information and documentation.
  • Cooperate with the Insurance Adjuster: An adjuster will investigate your claim. Be cooperative and provide any additional information they request.

4. Understanding Coverage and Compensation

  • Direct Compensation-Property Damage (DCPD): In Ontario, DCPD allows you to claim directly from your own insurer for vehicle damage, regardless of who is at fault.
  • Statutory Accident Benefits (SABS): These benefits cover medical expenses, income replacement, and other related costs. You are entitled to these benefits regardless of who is at fault.
  • Optional Coverages: Review any optional coverages in your policy, such as collision or comprehensive coverage, which may cover additional damages.

5. Follow-Up

  • Medical Treatment: Follow through with any medical treatments if you’ve been injured.  For most claims you are covered up to $3500 for treatment which should cover you up to about 6 months if needed.  This included Chiropractic, Rehabilitation, physical therapy and massage therapy.  We have all the forms here in the office  and help our patients complete them.  Most patients get better within 6-8 weeks, again dependent on the severity and any pre existing conditions.  Therapy usually starts with passive treatments including modalities (electrotherapy, U/S, Laser), Massage Therapy and Stretching.  As patients progress and get better We add more active exercises including active stretching and strengthening exercises.
  • Claim Resolution: Ensure that all aspects of your claim are resolved to your satisfaction, including vehicle repairs and medical benefits.
